{"id":1989,"date":"2025-03-06T13:35:02","date_gmt":"2025-03-06T18:35:02","guid":{"rendered":"https:\/\/www.mggl.com.mx\/?p=1989"},"modified":"2025-03-06T13:35:02","modified_gmt":"2025-03-06T18:35:02","slug":"flexibilidad-del-procedimiento-del-despido","status":"publish","type":"post","link":"https:\/\/www.mggl.com.mx\/eng\/flexibilidad-del-procedimiento-del-despido\/","title":{"rendered":"FLEXIBILIDAD DEL PROCEDIMIENTO DEL DESPIDO"},"content":{"rendered":"<p>Nos complace compartir el art\u00edculo, escrito por nuestro socio\u00a0Santiago Marv\u00e1n Urquiza, recientemente publicado en la 16\u00aa Edici\u00f3n de\u00a0<a href=\"https:\/\/www.linkedin.com\/company\/industria-legal\/\">The Legal Industry Reviews<\/a>\u00a0(Febrero 2025).<\/p>\n\n\n\n<p>La Segunda Sala de la Suprema Corte de Justicia ha confirmado la validez de la reforma al art\u00edculo 47 de la Ley Federal del Trabajo (LFT), estableciendo que la falta de entrega del aviso de despido <strong>solo genera una presunci\u00f3n de despido injustificado<\/strong>, pero permite que el patr\u00f3n pueda demostrar lo contrario.<\/p>\n\n\n\n<p>Hist\u00f3ricamente, la LFT exig\u00eda a los empleadores entregar un aviso escrito a los trabajadores despedidos, y su omisi\u00f3n implicaba que el despido se considerara injustificado.
