Genaro P\u00e9rez Vel\u00e1zquez, recientemente publicado en la 12\u00aa Edici\u00f3n de\u00a0<a href=\"https:\/\/www.linkedin.com\/company\/industria-legal\/\">The Legal Industry Reviews<\/a>\u00a0(Julio 2023).<\/p>\n\n\n\n<p>El derecho laboral en M\u00e9xico siempre ha defendido el principio de la estabilidad en el empleo. Pero, con las recientes reformas, estamos presenciando cambios considerables en este principio:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Antes, la Ley Federal del Trabajo (LFT) consideraba la estabilidad en el empleo como un derecho fundamental. Sin embargo, con las reformas, ha habido un cambio en su percepci\u00f3n.<\/li>\n\n\n\n<li>Si un trabajador es despedido injustamente, puede solicitar la reinstalaci\u00f3n. Pero hay excepciones seg\u00fan el art\u00edculo 49 de la LFT.<\/li>\n\n\n\n<li>En caso de eximici\u00f3n, el patr\u00f3n debe pagar indemnizaciones detalladas en el art\u00edculo 50 de la LFT.<\/li>\n\n\n\n<li>Con la reforma de 2019, ahora los patrones pueden depositar las indemnizaciones en el Tribunal paraprocesalmente, aportando informaci\u00f3n esencial del trabajador.<\/li>\n\n\n\n<li>Si hay desacuerdo sobre la indemnizaci\u00f3n, el trabajador puede tomar medidas legales. Si el Tribunal decide que no se cumplen los criterios para la eximici\u00f3n, el dep\u00f3sito de la indemnizaci\u00f3n queda sin efecto.<\/li>\n\n\n\n<li>Si el monto depositado es insuficiente, el Tribunal obligar\u00e1 al patr\u00f3n a pagar el saldo restante e intereses.<\/li>\n<\/ul>\n\n\n\n<p>Las reformas buscan agilizar los procesos y reducir tiempos y costos, pero es esencial estar bien informado.
